How do restaurants calculate the hours you work?

A friend of mine works in a decent restaurant in NYC. Thing is, they never 'time in' or 'time out' and there seems to be no recordkeeping of hours worked... Is this normal, or even legal? My friend is from out of state and finds this very unusual. How do restaurants calculate the hours you work?
Your friend is an adult and can calculate the hours that is worked and if the check doesn't match up then your friend should have the listed hours and take them to the manager stating that the hours are less on the pay check



You never know the manager might be doing every waiter a favor

It is called poor business practise. It is probably not "illegal" for them to run a crappy business, they may have good food, or what have you but it will come back to bite them in the rear if they have no records of anything.



Regarding the pay, they may pay a straight salary to the employee's and then the waiters collect tips throughout the week? They should manage to keep some records of time though, someone could fall and get hurt "off" the clock, and claim they were working (workmans comp claim) and the resturant will have no proof wether the worker was actually working or not when he/she got hurt.How do restaurants calculate the hours you work?
no its not illegal alot of places I worked in did it as an honor system where they would just pay you from the time you were scheduled til your cut does your friend get a pay check? what does his/her hours say on it if its less then he works tell them for a week or so write down them hour on his schedule and the hours they work and compare them to his/her hours on the check
