How do restaurants calculate the hours you work?

A friend of mine works in a decent restaurant in NYC. Thing is, they never 'time in' or 'time out' and there seems to be no recordkeeping of hours worked... Is this normal, or even legal? My friend is from out of state and finds this very unusual. How do restaurants calculate the hours you work?
Every employee should record their own time. A restaurant may pay according to scheduled hours, however I have never known a restaurant that did not ask staff to work later than scheduled.



I would check with your local restaurant association or the National Restaurant Association on this one.



In the past, I can tell you that I am pretty certain that if I did not pay employees for hours worked, I would be in trouble with the department of labor! We work with owners who are selling their restaurants, and when someone buys this restaurant for sale, we advise them to check the local labor laws to keep themselves out of trouble.

They probably just go by the schedule. If your friend misses a shift or is very late for one or something, they'd make a note of it and deduct those hours when they're doing the payroll.
