1) What happens if I can't find the lease by the end of the week? Could the mangement agency give me a new one? 2)should I ask about paying for the extra month? I've been a tenant in good standing here for over 13 years hopefully that should account for something.
I am a little unorganized w/my paperwork at the moment but w/all the homebuying info over the past few months, i may have inadvertently tossed my lease.2 things...(NYC) 1) Can't find my lease and 2) not renewing but need an extra month before I move.?
Usually if the lease is not renewed by the tenant and the landlord hasn't asked you to move out, the lease becomes month-to-month. What that means is that with so many (usually 30 days) written notice, either side can terminate the lease. Check your local landlord-tenant code. Be aware, though, that if your new lease included a rent increase you most likely are still responsible to pay the new rent and increase in security deposit if that's increased too. This is regardless of your renewing the lease or not.
Contact your landlord for another copy of your lease extension and/or ask if you'll become a month-to-month tenant if you don't sign the extension. it really depends on your state's laws. I would start with my realtor and see what they think and if they are uncertain, contact legal aid in your area and see if it would convert to a month-to-month lease. If you have a good relationship with your landlord, talk to them and see if they would be willing to do a one month lease with you. Be sure to get everything in writing. I know in Maryland if it does not state that it is going to be auto-renewed then it converts to a month to month lease. You still need to give notice but for a month to month 30 days works. But you need to see what the laws are in your area... ask an expert ;)
